BONDARCHUK Ya. O. The role of sectoral agreements in the development of social dialogue in the independent Ukraine

    The article studies the history of the signing of sectoral agreements and their role in reducing the potential for conflict and approval of civilized relations between the social partners. We investigate their role in the construction of elements of social partnership system, in particular the establishment of social dialogue. Also, this article discusses the practice of sectoral agreements as a factor in the introduction of elements of decent work in Ukraine, analyzes the experience and existing problems. Experience the conclusion of sectoral agreements practiced not only in Ukraine. In one form or another it exists in most countries with developed market economies. World practice of social and partnership at the conclusion of collective agreements shows the available features and differences in various countries. They are related to economic, social and political factors, the interests of certain social groups and more.

    Sectoral agreements are designed to strengthen the social protection of enterprises located in the area of the signatories to the agreement and aimed at improving the collective-contractual regulation of social, economic and industrial relations, the development of elements of the system of social partnership, implementation of constitutional rights and guarantees employees certain industry. Also, the settlement requires further regulatory framework legislation sphere of collective-contractual regulation. In amendments to the Law of Ukraine "On collective agreements" would be appropriate to provide suggestions ILO determine the degree of responsibility for Ensuring conclusion and implementation of sectoral agreements. The author concludes that sectoral agreements do not regulate the whole range of socio-critical problems. As a result there are collective labor disputes and conflicts. It should be noted that there is a problem implementation of sectoral agreements . During the evaluation, the parties disagree , in assessing the performance of their points. Typically, the full implementation of sectoral agreements were not recorded. The author concludes that sectoral agreements provide guarantees labor collectives on wages and provide the basic parameters for collective bargaining in the workplace. It should be noted that the expectation of rapid harmonization of relations in social and labor issues by establishing the elements of social partnership is not justified. However, social dialogue, including through the practice initiated by the conclusion of sectoral agreements has been a constant and improved.
